General Sales Conditions

1. Application

These general sales conditions (hereinafter ‘GSC’) apply to any sale carried out by the Hotel (hereinafter ‘the company’) with the client.

They cancel out and replace all previous versions that have been made available online and/or accepted by the client.

These current GSC apply to every use of the establishment, especially the commercialization by internet and telephone of all the services proposed at the establishment by the company SAS CHAILLY RESORT.

Therefore, it is imperative that the client carefully reads the GSC which are referenced with a hypertext link on every page of the website. It is recommended that the client downloads them and/or prints them to keep a copy for the day they place an order as from then on, the GSC are liable to be modified. It is pointed out that such changes will not be applied to orders for services previously carried out.

The GSC can be completed by specific sales conditions which figure in the service description as well as the service provider’s sales conditions, accessible either on their website or on the premises.

2. Capacity

The client acknowledges that they have power under law to contract, meaning they have the legal majority and are not under curatorship or tutorship.

The client equally declares to use the website in accordance with the current GSC, in their name and on behalf of all the recipients of the services ordered by themselves on the website of which they acknowledge being the authorized representative (hereinafter the ‘recipients’) and to which the present GSC will be opposable.

The client guarantees the veracity and the accuracy of the information provided by themselves in their name and on behalf of all the recipients providing their data on the website.

The company reserves the right at any moment to not contract with a client who commits fraudulent use of the website or who contravenes the current GSC.

3. Right of withdrawal

In accordance with the previsions of Article L 121-21-8 of the Consumer Code, the services proposed by the company on the website are not subject to the application of the right of withdrawal foreseen in Articles L. 121-21 and following of the Consumer Code regarding distance selling.

Consequently, the services ordered on the website are exclusively subject to cancellation and modification conditions foreseen in the current GSC and the client can not invoke the right of withdrawal.

4. Price

The prices are shown in Euros. The VAT is included in the proposed prices. Any applicable change to the rate, or any modification or introduction of new legal taxes introduced by the competent authorities, will be automatically reflected in the prices indicated on the invoice date.

The rates are per room and per night for the number of people indicated and according to the period selected.

The prices indicated only include the services strictly mentioned in the reservation. Additional services provided by the hotelier during the stay and, if applicable, the tourist tax will be added to the price mentioned in the reservation.

The prices mentioned on the website are subject to change at any time by the Hotel without prior information or notice. Only the price indicated in the booking confirmation by the company is contractual.

No stay which is booked before the establishment of a possible promotional offer will be subject to reimbursement, even partial.

5. Online orders

When placing their order, the client must:

- complete the identification form on which they will indicate all the requested contact details or provide their customer number if there is one,

- complete the online order form giving all the references of the products or services chosen,

- validate their order after having checked it,

- make payment under the conditions provided and confirm their order and payment in the event of an options for a non-refundable rate, or send the company their bank details in case of an options for a flexible plan,

- any reservation of more than 5 rooms may result in special conditions and additional costs.

The confirmation of the order implies acceptance of these conditions of sale, recognition of having full knowledge of it and the renunciation of taking advantage of their own purchase conditions or other conditions.

All the data provided, and the recorded confirmation will constitute proof of the transaction. The confirmation will be equivalent to signature and acceptance of the operations carried out.

The company transmits to the client, by any means (email, etc.), the confirmation of the recorded order.

The reservation is only firm and final after receipt of the confirmation sent to the client by the company.

The rates, terms and conditions of reservations are intended for the sale of hotel rooms in accordance with their primary purpose: accommodation. The Hotel reserves the right to modify or cancel the reservation(s), as well as the rates and conditions if the rooms are used for other purposes such as parties, dinners, meetings, photo or video shootings, film shoots, films or interviews, written or filmed interviews, photo shoots for social networks, showrooms etc…(non-exhaustive list) without prior written authorization from management. The number of guests in the rooms may not exceed the maximum room capacity declared to the Paris Police Prefecture (declaration available from the hotel management).

6. Online payment methods

Depending on the type of reservation made, the payment is due in full at the time of the order (non-cancellable, non-refundable rate) or at the end of the client’s stay at the Hotel (flexible plan).

In all cases to guarantee the reservation, the client is asked to communicate their credit card number, transmissions being done by secure mode.

In the event of payment at the time of placing the order, the credit card information transmitted by the client through a secure system to the company allows the latter to debit the card for the total amount of the stay, always in a secure manner. The bank account of the client is debited on the day of the order, the invoice being sent by the company to the client on the day of their departure from the Hotel.

In the event that the stay is taken over by a third party, the Hotel will require documents for the security of the transaction.

Please also note that the Hotel reserves the right to pre-authorize your credit card at any time prior to your arrival.

7. Modification and/or cancellation of a reservation

Cancellations and/or changes to reservations may be authorized according to the tariff plan opted by the client.

In the event of an option for a flexible plan, any request for modification and/or cancellation of a reservation must be made as soon as possible and at least 24 hours before the start of the stay.

The modification and/or cancellation of a reservation is only firm and final after receipt of a confirmation by email from the company.

The date of receipt of the modification and/or cancellation request (by email, post, telephone) is the date chosen for the cancellation.

In the event of an option for a non-cancellable non-refundable rate, no modification or cancellation will be accepted, and the total amount of the stay will be retained by the Hotel without the client being able to claim any reimbursement.

In the event of the client’s no-show at the Hotel and in the absence of cancellation:

the total amount of the reservation will be retained by the Hotel in the event of a reservation ‘Price not cancellable, non-refundable’

the first night will be charged by the Hotel in the event of a ‘flexible plan’ reservation

In addition, for a stay of at least 2 nights, in case of no-show by the client on the first day of the stay, the Hotel is not required to keep the room for the remainder of the stay.

The client is requested to plan to arrive at the Hotel before midnight and to notify the hotelier in the event of a late arrival, under penalty of being considered as not having shown up on the first day of the stay.

8. Overbooking

In the event of unavailability of the Hotel or in the event of force majeure, the latter reserves the right to have the client fully or partially accommodated in a Hotel or equivalent category or superior, offering similar services. The transfer will then be the responsibility of the hotelier which cannot be sought in payment of any additional compensation.

9. Interruption of stay/ early departure

A premature departure cannot give rise to any reimbursement.

10. Arrival and departure

At the hotel, check-in is from 3 pm (should you require an earlier check-in time, please let us know in advance and we will endeavour to have your bedroom ready earlier). Check-out is by 11 am. After 11am and for any late check-out, a supplement of €10 per hour will be applied.

At the gîte (apartments), check-in is from 5 pm (should you require an earlier check-in time, please let us know in advance and we will endeavour to have your bedroom ready earlier). Check-out is by 10 am. After 10 am and for any late check-out, a supplement of €10 per hour will be applied.

After 11:00 a.m. and for any late check-out, a supplement of € 10 per hour will be applied.

11. Animals

Pets are accepted for a supplement of € 15 per animal per day.

Pets must be kept on a leash in common areas and are prohibited around swimming pools and recreational areas.

The Customer will be held responsible for any damage and / or any degradation caused by their pet. As a result, the Company has the right to ask the Customer to leave

the establishment without any compensation and without any reimbursement of the current stay, and to reimburse the damage caused by these acts.

12. Additional services - Packages

Orders for ancillary services and / or packages can only be placed at the same time as the reservation of a stay at the establishment on a given and predetermined date.

They can only be used by the Customer during his stay at the Hotel. They may be modified and / or canceled only under the conditions of Article VII hereof.

13. Force majeure

Force majeure means any event external to the parties that is both unpredictable and insurmountable in nature which prevents either the customer or the hotelier from fulfilling all or part of the obligations provided for in the contract.

This is particularly the case in the event of a strike, insurrection, riot, prohibitions issued by government or public authorities.

It is expressly agreed that force majeure suspends, for the parties, the performance of their reciprocal obligations and that each party bears the cost of the resulting costs.

Customers will bear only the additional costs that could be incurred to allow the continuation of the trip, following the occurrence of a case of force majeure.

14. Complaints

Any complaint must be sent to the following address: HÔTEL GOLF CHÂTEAU DE CHAILLY - ALLEE DU CHÂTEAU - 21320 CHAILLY-SUR-ARMANON, within 15 days of the departure of the stay which is the subject of the said complaint. After this period, no complaint can be considered.

15. Information technology and freedoms

In accordance with the Law 78-17, known as the Data Protection Act, customers are warned that their reservation is subject to computerized personal processing. Customers have a right of access and rectification of the data entered, which is exercised at the head office: HÔTEL GOLF CHÂTEAU DE CHAILLY - ALLEE DU CHÂTEAU - 21320 CHAILLY-SUR-ARMANON. It is specified that this information is not communicated to third parties.

The Company offers wifi internet access. The Customer undertakes that the computer resources made available to him will not be used in any way for the purposes of reproduction, representation, provision, or communication to the public of works or objects protected by a right. Copyright infringement, by a neighboring right such as texts, images, photographs, audiovisual musical works, software and video games, without the authorization of the holders of the rights provided for in books I and II of the intellectual property codes when this authorization is required.

The Hotel has a video surveillance system in the common areas of the building.

16. Responsibilities

The Company declines all responsibility in the event of theft, loss, or damage to the personal belongings of customers during their stay.

The Customer will be held responsible for any damage, any degradation, any act of vandalism that could occur due to the occupation of the premises and / or the fact of the participants and / or the staff for whom he is responsible, both to movable, decorative, and real estate belonging to the hotel. As a result, the Company has full discretion to ask the Customer to leave the establishment without any compensation and without any reimbursement for the current stay, and to reimburse the damage caused by these acts.

The Company, in the online sales process, is only bound by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, interruption of service, or other unintentional problems.

17. Applicable law

These General Conditions of Sale are governed by French law. This is the case for the substantive rules as for the rules of form. The disputes will fall under the exclusive jurisdiction of the French courts.
